Study On The Legalization Of Surrogacy And Its Legal Regulations

Surrogacy is the result of the high-speed development of medical science and technology. Since surrogacy touches on many questions about morality, legislation and so on, its appearance has given rise to a fierce debate, especially the identity of surrogate children has become the core of the debate. Various of countries adopt different attitudes about surrogacy, and now China forbids surrogacy positively. The thesis plans to analyze the nature of surrogate contract and provide some theoretical discussions of the relative controversial issues about surrogacy. The thesis also expounds the necessity and positive significance of legitimation to surrogacy, and tries to draw lessons from the advanced legislation of other countries and areas, eventually brings up the relative legislative principles and items of《Surrogacy Law》. The writer look forward to the legitimation of surrogacy and anticipate that it will bring constructive effect into full play.
