Economic Legislation In The Late Qing Dynasty Study

The Chinese society of Late Qing dynasty is in a period of rapid social change ,and also the period of transition from traditional to modern society. Late Qing Dynasty as Modern China began economic changes in the legal system from traditional to contemporary was an important stage for the system toward modernization. For a country with a long legal tradition of the structure, this was a substantive change. Therefore, the author hope that through the study on the economical legislation of the Late Qing Dynasty, while referring to study results from related disciplines, we can study in depth the Late Qing Dynasty of China' s economic transformation.In this paper the structure and main contents of the article are as follows:Part 1. The Economical History of Qing Dynastry. This section briefly inspected the contents of the Qing Dynasty economical law. Qing' s economy ,is the natural self-sufficiency and economic development when adapted for the feudal economic development. But at the same time with the social and economic development, it also severely affected and restricted the seeds of capitalism and social development of the Qing Dynasty.Part2. Beginning Late Qing economic legislation. This section assayed the Western powers invading the enormous impact of the traditional Chinese society, after the Opium War, followed by a major cultural change of the traditional Chinese legal system based on the number of factors-including economic, political, social, ideological, this objectively calls for economic reform legislation. However, with the Qing Dynasty rotten to the core and declining and because of its longtime and widespread dictatorial system the legislative process in the economic development was doomed to be tortuous and complex.Part3. The Late Qing Dynasty legislative practice. This section describes that to prevent the country from meeting its doom, it had to change its economic system, and thus started the process of modernization of China's legal system. This section tells about the functional institutions the Qing established and their influences, and meanwhile elaborates on the contents of the main economic legislation and the importance of economic development.Part4. The structure of Late Qing economical legislation and Modern economic systems in China. The economic laws are the specific economic and legal system. Legislative contributed to the Late Qing Dynasty in China's recent economic changes in the economic transformation of the legal system, the modern economic system has also appeared in china. This chapter inspected the relationship between the Late Qing's economic legislation and business management system in modern China economic organization the formation of modern markets financial system etc.Part5. Review of the Late Qing Dynasty economic legislation. This chapter reviews the historical status and role of the Late Qing Dynasty economic legislation and also analyzes the history limitations of Late Qing's economic legislation and the inspiration to the building of contemporary legal system. The writer believes that despite of its failure for various reasons the Late Qing's economic legislation is worth our thinking about as China' the first large-scale modern sense legal reform movement."Today's observation, but should learn form the past, if not ever, then there would be no today". The objective study of history, in the final analysis, is a real draw. China today is in the transition period economic planning and the building of the legal system are under the control of country for months only to see an orderly change. Reforms need for a scientific theory, but also need to learn from the historical experience of foreign countries. And the Late Qing Dynasty economic legal system may also experience changes in the current economic and social reforms with a more direct role in enlightening. Intended to be with the guidance of Marxism, we are to conduct investigations and research on the Qing Dynasty and economic legislation from history, probe into basic lessons from early changes of the legal system in the process of modernization of China and attempt to make a more objective assessment of its historical status and influences.
