Surrendered To The Study Of A Number Of Issues

Voluntarily Surrendering system is one of the important penalty regulations in the Criminal Law of People's Republic of China. It is beneficial to disintegrate criminals, to inspire criminals to repent and reform, to defend the normal social order, to save judiciary cost and to prevent crime. Therefore, defining Voluntarily Surrendering accurately is of great significance to combat with criminals, to improve efficiency and to implement relevant punishment. This article seeing from practical aspect, integrating with work practice, has explored superficially to the voluntarily surrendering system of our country in five chapters. The first chapter is mainly about summary of voluntarily surrendering in our country from its legislative development, concept and essence. In the second and third chapters, cognizance qualifications of common and special Voluntarily Surrendering are discussed respectively. How to cognize Voluntarily Surrendering in practical point of view such as the effect of motivation in the process of Voluntarily Surrendering cognizance is specially discussed in the forth chapter. In the fifth chapter, penalty problems of voluntarily surrendering criminals are briefly introduced in the aspects of relevant legislation regulations and judicatory judgment etc. through these five chapters, it is expected to understand the Voluntarily Surrendering system further more.
