China Wildlife Habitat Protection Legal Issues

Protecting the wildlife habitat is an efective method and key measure, since good habitat status improves the survival and expanse of the population of protected species, benefits the development of other related natural resources and maintain the ecological balance of the nature. Therefore, the conservation of wildlife habitat is one of the most important part of the research and management of wildlife. Today, wildlife habitat protection has been increasingly emphasized by all countries in the world. It has become a problem needed resolving urgently that how to realize the harmony of wildlife habitat protection and development so as to avoid the serious relation between human and wildlife in the course of economic development. According to experiences of other countries, law with harshness punishment was very effective in countermeasures adopted to resolve wildlife habitat protection problems.This paper covers four parts. The first part is the introduction to the wildlife habitat, which will make clear the concept and classification. Then the feasibility and necessity of resorting to law in protect wildlife habitat was theoretical analyzed in this paper. The second part is aimed at the comparison with America,England,Costarica and Japan, which will provide reference to our country. In the third part ,the author dwelled on the situation of wildlife habitat protection legislation ,practical problem and legal defection in China. Actually, the author focuses her point on the fourth part. The legislative principles were argued at fist in this part. Then the author interpreted the urgent need to strengthen the law in wildlife protection cause. Several legislative suggestions are put in the paper. The author expected it would be helpful to work in drawing the wildlife habitat conservation, promoting the coordination of conservation and local economic development, consolidating the wildlife habitat and sustainable development.
