Corruption crimes such as taking bribes have become increasingly serious with the rapid development of society, plaguing the international community. From the twentieth century on, theoretical studies and criminal legislation on the crime of taking bribes have been conducted with greater intensity in many countries (regions) and such international organizations as the United Nations. As a result, legal documents in line with different countries'reality have been formulated, constituting a common cultural and spiritual legacy for the whole mankind. In view of these situations, it is of vital significance to perfect the legislation on the crime of taking bribes in the Criminal Law of China, with the aim of combating corruption crimes, speeding the modernization of Chinese legislation, as well as conforming to international practices. This paper is a comparative study of Chinese and foreign legislation in terms of the subject of the crime of taking bribes, range of bribery, and criminal penalty. It also puts forward specific suggestions on how to improve the currently-in-used relevant provisions in the Criminal Law.
