Considering the relevant prescription and theories on this system in China and other countries, the ownership of apartment building is a compound real estate ownership. If defined by the Trinity Theory, it is a right composed of the exclusive right, the co-ownership and the ownership. The characteristics and condition of the building should be taken into consideration while deciding the range of the co-ownership while exercising the rights and offering relief of rights, but it's different because of the special characteristics of buildings. This conception of the system should contribute to the theoretical development of the system in our country and the legislative improvement and to the protection of civil rights in our country. |
