Perilous Research

This paper studies potential damage offense from five aspects mainly.The first part introduces the legislative value of potential damage offense.The second part analyses the danger in the criminal law. I believe that the danger in criminal law not only includes the danger being an act itself, but also includes the results of the danger, however, the danger of potential damage offense is an objective existence, So the danger of potential damage offense embodies the nature of results of the dangers, rather than the nature of acts.The third part expounds the concept of potential damage offense. Through analyzing and commenting currently three theories, I think we should define the concept of potential damage offense from consummation of crime. In the next step, I make a further study of the criteria of the dangerous statusThe forth part discusses the classification of potential damage offense, especially discusses the classification of concretely potential damage offense and abstractly potential damage offense.The fifth part elaborates relationship between potential damage offense and other related concepts.
