Juvenile Delinquency Execution Of Social Problems

As the limiting criminal law develops, the execution of punishments undergoes a great change and the socialized execution of punishments has become a key way of the execution of punishments. With the launch of the pilot Community Correction, the theory and practice of the socialized execution of punishments in China has entered a new stage of development. As a novelty, however, the socialized execution of punishments in China needs to be improved, especially the socialized execution of punishments for juvenile delinquency. At present, the legislative provisions about the socialized execution of punishments for juvenile delinquency in China are so unclear that they can not meet the need of practice. For this reason, this article first outlines the theory of the socialized execution of punishments, then explores the status and inadequacy of the socialized execution of punishments for juvenile delinquency in China and finally makes some proposals about the improvement of the existing systems and the construction of new ones. In addition to the conclusion, this article consists of five chapters:Chapter one: the general introduction to the theory of the socialized execution of punishments. This chapter consists of two parts. The first part makes an analysis of the concept of the socialized execution of punishments and determines the content of the socialized execution of punishments in this paper. The second part explores the origin and development of the theory of the socialized execution of punishments.Chapter two: the socialized execution of punishments and the juvenile delinquency. First, this chapter makes an analysis of the status and characteristic of juvenile delinquency in China and then discusses the necessity and feasibility of the socialized execution of punishments for juvenile delinquency in China.Chapter three: the systems of the socialized execution of punishments for juvenile delinquency abroad. This chapter makes an brief introduction to some concrete systems of the socialized execution of punishments for juvenile delinquency in the United States and Germany, with a view to provide some useful experiences for the construction of the systems of the socialized execution of punishments for juvenile delinquency in China.Chapter four: the practice and inadequacy of the systems of the socialized execution of punishments for juvenile delinquency in China. This chapter especially probes into the adequacy of the systems of the socialized execution of punishments for juvenile delinquency in China, in the hope of specifying the goals and directions of the improvement of the systems of the socialized execution of punishments for juvenile delinquency in China.Chapter five: the improvement of the systems of the socialized execution of punishments for juvenile delinquency in China. With respect to the inadequacy of the systems of the socialized execution of punishments for juvenile delinquency in China, the author makes some suggestions about the improvements and puts some ideas about the construction of new ones.
