The Creation Of Its Private Law Protection Of Environmental Rights Of Our Citizens

The article introduced real bases and theory of environmental right, expounded feasibility and necessity of establishing environmental right, commented subject, object and content of environmental right. The author introduced legal system about environmental right in foreign countries. By analyzing our legal system, author brought forward his idea about legal construction of environmental right.This article consists of five parts.PartⅠis the preface of this article, it has expounded writing background of this article, and resent theory research on environmental right.PartⅡsets forth the real basis and rationale of environmental right, explain the theories of environmental right: common trust theory, human rights theory, sustainable development theory, intergenerational equity theory. On this base, the author explained the relevant concept about environmental right and its composing elements.PartⅢFirst, the author introduced legal system of environmental right in other countries. And then, analyzed the situation in our country by constitution and special law, points out problems in environmental right protecting, expounded the necessity of constructing environmental right. At the end, the author has brought forward his idea about legal construction of environmental right.PartⅣ. First the author analyzed legal nature of environmental right, including private interests and public interests aspect. Then, study on how to protect environmental right by private law. On this base, author gave his idea on how to improve to protect environmental right.The last part is concluding remarks, emphasized the environmental problem and necessity of constructing environmental right.
