Along with development of Economic Globalization, the exchange of Economy, Culture and Personnel between nations is frequent, international civil and commercial disputes are increasing. It plays important role to settle international civil and commercial disputes in protecting parties'legal interest and promoting the exchange of Economy, Culture and Personnel between nations. Service abroad system is significant of litigation system, and integrates all parts into litigation. International civil and commerce litigation don't begin without service abroad. Service abroad system plays important part in settling foreign disputes. Service abroad is a very important part of international civil procedure. The success of service abroad has relation to settle international civil and commercial disputes. In recent years, efficiency and success of service abroad is low. These problems severely delay international civil and commercial litigation, and waste limited judicial resources. Justness and efficiency is eternal subject. The delay of justice means to deny justness. International civil and commercial disputes are not resolved and image of justness is impacted, because efficiency and success of service abroad is low. In this thesis, the author tries to find the reasons for inefficiency and fail of service abroad and inequity. Using successful experience of foreign countries on service abroad, the thesis put forward some proposals in order to settle problems of service abroad and construct and develop service abroad system in China.
