Personal Credit Information Privacy Legal Analysis

The Personal Credit Checking can be defined as collecting, processing and controlling the personal credit information by the credit checking institution, and providing the personal credit information according to the requirement of the clients as well. Most of the personal credit information belongs to the objective of the right of privacy, which leads to the conflict between the personal credit checking and the protection of privacy. How to protect the holders of the privacy is a main task confronting to legislation and application. The legal system relating to the personal credit checking is not matured. That is why the author selects this topic.The dissertation constitutes of three parts. Firstly, the author introduces the concept and general information of the personal credit checking and privacy on which the author analysis the necessity to protect privacy during the personal credit checking. Secondly, in a compare law perspective, the author proposes that it is essential to stipulate law on the confines, approaches, users, intention and right of relating people. In the end, the author makes a proposal about the privacy protection to the law of our country.
