Sexual harassment in the workplace has become a tough problem in China, but relevant laws and regulations are insufficient. With the appearance of the cases on sexual harassment in the workplace, more and more scholars pay attention to this problem. Most of the scholars study this issue from the perspective of the tort law, while few of them do the study from different angles. This article aims to study the problem of regulating sexual harassment in the workplace from the perspective of the labor law.This article is consisted of a preface, the main test and a conclusion. The preface states the seriousness of the issue on sexual harassment in the workplace in China. The first part of the main test analyzes the cases on sexual harassment in the workplace to reflect the problems in judicial practice. From these problems the urgency to regulate sexual harassment is shown. Then the definition and types of the sexual harassment in the workplace are introduced. The second part of the main test presents and compares the laws and regulations on sexual harassment in the workplace abroad, and concludes the trends of regulating. The third part of the main test brings forwards some principles which should be followed when regulating sexual harassment in the workplace for the future by analyzing relevant laws and regulations in China. The fourth part of the main test discusses the way of regulating sexual harassment in the workplace in China. The conclusion summarizes this article and points out that the settlement of sexual harassment in the workplace also needs the cooperation and efforts of the whole society besides depending on the law.
