On The Improvement Of The System Of Villagers' Committee Elections In China

The system of Election to Village Committees is a system under which the peasants on behalf of villagers vote for village committees who are the basic people's autonomy organizations, according to organizational and active regulations about rural authorization from the Constitution and laws. The system of Election to Village Committees taking peasant autonomy as its basis is the essence of Chinese peasants' intelligence, which has significant and positive meaning to the construction of democratic politics for our country. It has taken the consideration domestically as well as abroad. Since 1998, when new Organizational Law on Village Committees went off effect, there have been broadly and actively exploration and practice in election to village committees all over the country. However, which should be seen is that election to village committees is a system which needs a lot of standards in practical management and the connections to specific situation for different distinct. Therefore, there are also many issues in both systematically and practically, though there have been some achievements. This paper demonstrates the perfection of election to village committees system by the following four parts: The first part generally introduces the basic theory of election as well as that of election to village committee in China, including the concept of election, the categories, and the definition, types and the basic principles of election to village committees in our country. According to the basic theory and basic principles, the following parts continue. The second part concludes the status of election to village committee in China, the problems are concluded by observing the status. There are issues on both systematically and practically. Systematically, laws and rules related can't meet the need. Although the organizational law of election to village committees has confirmed the legal status for election to village committees, there are only general and directional provisions, there are a lot of problems in practice, such as deceit for votes, interfere from town government, and the negative leading from the Party organizations, etc. The third part analyses the reasons of the problems which exists in the election to village committees, including legal reason, administrative reason, economic reason and thought reason. Generally, the legislation has a shortage, there are a lot of situations with administrative interfere, the election to village committee is influenced by the economic aspects, and the peasants have no enough democratic thought. The forth part poses the solution to the problems referred in the above part. The suggestions include legislation perfection, adjusting the relation between government and the village committee as well as the relation between the Party and the village committee. Moreover, the supervision system should be strengthened. The stability of rural areas are related to the stability and development of our country. The system of election to village committee is an important system for peasants' autonomy. Therefore, this paper is going to pose the solution to the problems, which exist in election to village committees, so as to provide some power to the perfection of system of election to village committees.
