The Online Gambling Crime And Its Prevention And Control Countermeasures

There are three sections altogether in this dissertation in more than 33 thousand words. In view of the theory of crime and criminal law, the author advances his research of network gambling crime in China with his working experience integrated.In section one, the author is in research of the ordinary problem of network gambling crime. The author firstly makes a brief introduction of the history of the gambling and of the attitude the authorities take towards the gambling in China, accordingly, to regard the ordinary gambling as breaking the laws, which is regulated in laws in connection with public security management, however, to regard the serious gambling as crimes which is regulated in criminal law. That lays a legal foundation on the research of network gambling crime. Owing to the fact that network gambling crime is a crime in new type, the author makes a comparison between the traditional gambling and network gambling. Combined with the character that network gambling crime belongs to a kind of network crime, the author gives the concept of network gambling crime, analyzes on the different character, type and hazards in contrast to the traditional gambling. Thereafter, the author briefly explain the current condition of the network gambling crime and some typical cases have been inspected in China, to assert the importance of striking.In section two, the author mainly makes an analysis of the reasons of network gambling crime. The author firstly explain the reasons of the crime of network gambling crime. The reasons are complex and multi-dimensional, furthermore, the reasons influence each other. Therefore, the author make a conclusion of the reasons of crime in view of the individual and the whole society. The section lays solid foundation of the section three.In section three, the author is mainly in research in the countermeasure of control and prevention towards network gambling crime, that is the important part of the dissertation. The author mainly gives the measure towards network gambling crime in three aspects: the legal measure towards it, construction on policemen'network, social management of network gambling crime. The author explains in four aspects respectively: governing, applicable laws and legal management of network gambling crime. In the section of the construction of policemen'network, the author makes an analysis in three aspects: inspection, testimony, network governing and strengthening the technology. The author also explains the problem of integrated management, international cooperation, special protection of the youth.In the last section, the author predict the long term in which network gambling crime exists and makes an conclusion of establishment of research system towards network gambling crime on long term basis.
