Title rentention is an old and new legal system.lt was old because it derived from Roman law with a long history and plenty practices. It is also new because in China it appeared later, moreover our legal stipulations are not sufficient. The newly passed Properties Law hasnot enriched it.Because title rentention is not a typical guarantee system, researchers pay less attention to it than traditional guarantee systems.Our current legal education also involves little. But with prevalence of installment, title rentention are increasingly transparent in our ordinarily life. Title rentention is an elaborately designed and less-cost legal system with guarantee function.After reading a lot of materials,we find the variours nations prescribe diffient rules for title rentention.This dissertation intends to discuss the legal issures from different angles to acquire a clear and corrent understandings of it. This dissertation obtains the parts listed as follows:In chapter 1 ,the concept and character of title rentention are discussed.We also analyse it with relative systems.In chapter 2,we mainly discuss the nature of divergent opinion and obtain the understandings of its nature.In chapter 3,we discuss the makings and publications of title rentention.About making.we analyse the time.form of it and also we talk about the scope of application of title rentention.About publication,we talk about two different legislative model,the current stipulations of different countries and the right selection of our country.In chapter 4, we mainly discuss the legal effect of title rentention.The buyer's expecting right and the seller's fetching right, the key issures of title rentention are separately researched. Furthermore,the transportation of risk that is the loss of goods is also discussed.
