How to establish a unattached duty system in the economic laws has always puzlled the Chinese law researchers. To the economic laws, the unattached duty system is essential part. So the Chinese law researchers have never forgiven it and have done many useful experiments. But on this question there still exist some disputes. This paper contains four parts. In the first part, it analyzes some conceptions about the legal duties of the economic laws, it definitudes the title of the duties and the ecumenical definition of the duties. It also opens out the essence of the economic laws by analyzing what and how the economic laws regulate. In the second part, it limites the scope of the duties, to distinguish the duties from the others. In the third part, it describes five common characters of duties: sociality, inequality, special functions, special realizing processes, special frondose forms. In last part, it gives some advices about how to establish a unattached duty system in the economic laws: to consummate the correlative laws, to set up commonweal proceedings, to reform realizing processes, to improve intendance systems. This paper may not appease the debates among the academe, but it brings us some new angle to study the question.
