Study Of Work-related Injuries Compensation Mode

In modern industrial society, work accidents are inevitable and frequent social problems, which have important impact for stability and economic development of a country.However, in China, theoretical and practical research in the field is lacking, which has not formed a unified compensation mode of work accidents, leading to legislative and judicial confusion. So I think that the research of compensation mode of work accidents that has important practical significance in China.Through using legal theory results and analysing the status quo of foreign and domestic, This paper bring forward that the ideal compensation mode of work accidents should be the supplementation mode in China. The meanning of the supplementation mode is that industrial injury security is the first method and civil damage is the supplem method.This paper includes two chapters. Chapter one attempts to define concepts of work accident and the nature of work accident; then reviews the origin and history of the legal system of work accident compensation; finally, introduce and Analysis the four modes of overseas work accidents compensation. Chapter two, analyzes and perfec the choice of compensation mode of work accidents in china. First, by analysising the existing legislative model about work accidents compensation in China, the supplementation mode is considered to be the best option; Then, demonstrate rationality of the supplementation mode by theoretical and practical analysis; Finally, discusses how to perfect the legislation and judicial practice about compensation mode of work accidents in China.In the entire verification process, by using the historical analysis,the comparative analysis and the methods of linking theory with practice,the author puts forward constructive views for the compensation mode of work accidents and hopes that the views would become theoretical references for the future of the relevant legislation and judicial practice.
