As a kind of practical science, practical teaching is an important part of legal education system, which is related to realization of teaching aims and determines the quality of undergraduates'legal education. Therefore, it is an important promise to improve the quality of legal students to attaching importance to or strengthening the study and enforcement of legal practical education.As the development of Chinese marketing economy, democracy and the rule of law, we attach more and more importance to practical education. Some universities which have a long history of law science lay more stress on reflection of their experiences and its significance during legal practical education.But as a whole, Chinese legal education still stress teaching, but neglect students'study; stress conclusion, but neglect period; stress theory, but neglect practice; stress professional knowledge, but neglect comprehensive quality. Compared to theoretical education, the study on practical education is less profound. And there is still a long road to its systemization.In the long period of my practical teaching, I have taken some effective measures, such as setting up practical education base and making evaluating rules for directors, etc. At the same time, I keep on reflecting the problem and find that there have been no systematic studies on it. In the thesis, I make a preliminary study on the systemization of practical education. The five parts are as following:Partâ… Introduction In this part, I mainly make a connotation of legal practical education and introduce aim and background of the thesis, the status quo of Chinese research on it, main references, methodologies and main contents.Partâ…¡In this part, I analyze the legal practical education in aspects of its background, aim and reality, conclude macro-background of the rule of law, marketing economy, entrance into World Trade Organization and progress of human rights, clarify the aims of legal education should be legal profession, and prove its important role in legal education.Partâ…¢In this part, I compare the methods of legal practical education in countries of civil law and common law and point out that some developed countries lay much stress on legal practical education and they have had many valuable experiences. However, we should consider Chinese economic situation and current education models while absorbing legal practical education models to set up our legal practical education system. Therefore, it should include three levels, i.e., practice in legal departments, clinic education and stimulated court and legal help which combine educations of universities and society, long and short period, legal practice and legal profession and study and social activities.Partâ…£In this part, I analyze the factors influencing legal practical education and put forward its sustaining systems, including systems of courses, organization, staffs, insurances and evaluation.Partâ…¤In this part, I mainly sort out the status quo of legal practical education, devise a new model in aspects of connotation, credit, content, form, evaluation and score and establish a more detailed model that is based on practice in holidays and emphasizes legal help. Since the scale of legal education is more and more extensive, it is even more important to emphasize the meanings of legal practical education. The meanings and creations of the thesis are:1. To combine the extensive practical education and form a system according to theoretical research. The forms of legal practical education are abundant and case education, court participation, legal clinic, simulated court, legal consultation and legal practice were used in legal education. However, the links above had not been systematized. To sum up, there were five forms, i.e., holiday practice, court participation, simulated court, legal help and legal clinic. Because of the systemization, we could make unified planning in the four years of students'undergraduate education to make things convenient for students and teachers and provide an important chance for students to exercise their skills and qualities.2. To put forward a model and the concrete details based on a sustaining and an operating system. As to the model, it is a three-leveled legal practical education. The sustaining system is the combination of five systems. The operating system combine the courses and devise the times and contents.3. The thesis is based on my experiences and theoretical reflection of legal education in last seven years. The conclusions are very operative and have been verified in practice. Besides, they have also got a high praise from experts of Education Department and the scientific research on it has also got the third-prize of Experiment Teaching and Achievements in Universities of Shandong Province.
