On The Joint Principal Offender

With the development and the change of the society, the theory of the joint crime has been paid attention in the academic circle of the law. Especially the issue of the joint principal offender has lead to much controversy. Hence, this article will examine the matter from the angles of the issue of the principal offender, and will discuss this issue deeply. For details, firstly this article talks about the definition and the essence of the joint principal offender with the analysis of the constitutive requirements of it, including the subjective and objective requirements. Furthermore, this article talks about the issue of the crime-shared accessory, one-side joint principal offender, unpremeditated joint principal offender and successive joint principal offender and the related theory. According to the theory of partly criminal common, this article discusses this issue from the different angles deeply and thoroughly, and finally gives my viewpoints on those issues. In one word, during the whole process of the discussion, the article doesn't only consider the problem based on our criminal code and theory, but also refers to the foreign related theory. The aim of this article is to make some contribution to the development of the theory of joint principal offender.
