Foreign Mergers And Acquisitions In The Evasion Of Law

Goes along with the development of international trade and investment, the target of Private International Law (hereinafter referred to as"PIL") research has been undergoing an essential change. Both the regulations related to foreign citizenship, conflict law, unified substantial regulations and international litigation and arbitration procedural laws are considered in the field of PIL. Hence the definition of the term"Evasion of Law"has been supposed to be renewed.It is many legal risks leads to the diffusely occurrence of Evasion of Law, particularly in the field of foreign acquisition and merger in PRC. Both the legal risks and vehicles of Evasion of Law are to be discussed in this article. And the validity of Evasion of Law in Foreign Investment practice should also be re-considered beyond the traditional understandings.
