The principle of universal jurisdiction is a traditional topic in the area of International Law . In , the famous jurist Hugo Grotius proposed the doctrine of extradition or prosecution ("aut reddere, aut punier"), which can be regarded as the original theory of the principle of universal jurisdiction. Nowadays, the principle of universal jurisdiction has developed a lot, and many scholars have studied on this issue. Because this principle weighs a lot both in theory and in practice, the author devoted on this problem and made a brief discussion in this paper.First, the author analyzed the sources, meanings of the principle of universal jurisdiction, furthermore, the author discussed several other cases, in order to analyze how the principle being used in practice; Second, by comparing the principle of universal jurisdiction and the jurisdiction of International Criminal Court, we can conclude that they are related with each other and complementary; Third, by briefly expatiate the legislation of the principle of universal jurisdiction in two countries representing two legal system, the author discussed the legislation and development of the principle of universal jurisdiction in China. |
