In recent years,cases which embryo had been violated occurred frequently,but legal regulation to the problem seems to be backward relatively. The situation is only referred to by Succeed Law in our country. Imperfect legislation makes the interests of embryos out of the protection of the law, only making it in a passive"against accepting"status. However, with the continuing development of the medical, biological technology, the modern concept of human rights is popular, as well as the degree of the concerning of embryo has been continuously strengthened, which requires a legislature response to the problem. In order to prevent the contradiction between the violation of embryos and legal remedies from being further expansion and make the subject of the law in the future receive comprehensive protection, we need a systematic and detailed discussion about the forefront stage of the"man"in the law . This paper attempts to seek the protection for the rights of the embryo from the objects civil status and the requisition rights of the embryo's damage and compensation.
