The Problems Of The Crime Of Research

For recent years, criminal cases caused by traffic accidents increased. To crack down on the criminal offense of such kind criminal legislation and judicial interpretations in China are changing to perfect, although there are many controversial themes both in theoretical and practical levels. Guided by socialist criminal justice principles and based on studies of traffic accident crimes, this article discusses several problems, such as offender capabilities, absconding from accident, joint offense and surrendering, through comparing the text of Criminal Code and judicial interpretations causing disputes. The problem about responsible subject in civil suit collateral to criminal proceedings is also concerned on the background of combination of theory and practice. Author has developed unique points of view and tends to give some solutions for various complicated problems arising in judicial practice.
