On The Entrapment

Encouragement investigation is a special detective measure which is commonly admitted in legislation and judicial practice in world. It has been accepted by a lot of countries'legislation. With the development of the community and the economy, encouragement investigation plays an important role in detecting some special crimes, such as organized crime, drug crime, false currency crime and crime committed with similar ways in given places as well, which are difficult to be detected if we use traditional detective measures. But the relative legal system in China is not established yet, and lack of the legislation will necessarily result in some practical problems, therefore it is necessary to set up a legal system to control encouragement investigation. This article begins with the concept, characteristic about encouragement investigation ,deeply argues the legal standards of this detective measure and relative legislation in other countries. This thesis analyzes and discusses the legal validity and reasonableness from the view of legal theory and the legal consequence. Finally, the article conclude the setting up of perfect legal system of encouragement investigation.
