On The Crime Of Losing Firearms Without Report

China's 1997 Criminal Law section 129 provides for the crime of loss of guns without reporting. The establishment of this crime reflects China's strict gun control system from the perspective of criminal law. But criminal law theory group has large difference in the subject aspect and the relationship between cause and effect of the crime of loss of guns without reporting. This paper has an elementary discussion of the criminal structure of the crime of loss of guns without reporting, in order to have a hope that my crude remarks may draw forth by abler people and to complete the structure of this crime, and make this crime more reasonable in its application. Firstly, this paper gives a redefinition of the subject of this crime; secondly, to the criminal object, this paper makes a research about the confirmability of the loss of the gun, the meaning of not reporting in time, the definition of the harmful conduct and result and their relationship between cause and effect; thirdly, this paper makes a discussion of the subjective aspect of this crime; finally, this paper makes a discussion of the mode of legislation of this crime. The writer believes that it is more reasonable for this crime to adopt the mode of legislation of conduct criminal.
