As a social phenomenon, the non-marriage cohabitation has to be supervised by morality and system. In China, due to ethical and legal reasons, the non-marriage cohabitation has been regarded as "illegal" for a long time. In stead of reduction, however, the number of people who choose non-marriage cohabitation as their family lifestyle has been increasing. To improve the system of marriage and family, it is necessary to legally regulate the identity and property relationship between parties in non-marriage cohabitation.This article is mainly composed of four parts besides the introduction and the conclusion.The origin and development of non-marriage cohabitation is generally introduced in the first part, as well as the defination of its meaning and its classification. The non-marriage cohabitation is defined as a relationship against marriage through analysis of non-marriage cohabitation, illegal cohabitation and de facto marriage.In the second part, the reason of the rapid development of non-marriage cohabitation in China is analysed. Chinese present marital legislation is regarded as inadequated and it's the need of respecting and protecting human rights and of social justice to regulate non-marriage cohabitation legally.The third part is about the legislation for non-marriage cohabitation in foreign countries. The basic theory and pattern of legally regulating non-marriage cohabitation and the development of legislation are included.The construction of the legal regulation for non-marriage cohabitation in China is mentioned in the fourth part. The principle and pattern of regulating non-marriage cohabitation are mainly discussed. Finally, a detailed design of the legislation for non-marriage cohabitation is put forward.
