Administrative Procedures Against The Law Of Judicial Review

Modern Administrative Procedure Act is the vital sign of the Administrative law theory maturity. It not only makes people realize the independent value of procedures, but also clarifies the procedures of the citizens'rights in legislation. However,right without relief is not really the right. Judicial review as the final barrier of relief right, the practical realization of procedural rights established by the procedure law must rely on the protection of Judicial Review, and the rules of procedure can receive the same strict compliance by administrative subject as substantive rules do. Therefore, judicial review of administrative procedures illegality has become a hot research and focus among administrative law academic.This article is divided five chapters:Chapter one was expounded the importance and meaning of judicial review of administrative procedure illegality. In addition, it was analyzed the situation of research project.Chapter two was analyzed the cause of the problem and find entry points to solve it by means of the problems of the issue.Chapter three was elaborated the theoretical basis of judicial review of administrative procedure illegality mainly from three aspects: the judicial power protection theory, the procedural justice theory and the procedural sanctions theory.Chapter four was summarized some enlightenment to the judicial review of administrative procedure illegality in China, by comparative analysis of the concept , basis, standards and methods of the judicial review of administrative procedure illegality between Two Schools :Common law and Civil law.Chapter five was probed the route choice of the improvement of judicial review of administrative procedure illegality, in a bid to make an in-depth analysis of idea update and system building of judicial review of administrative procedure illegality.
