By the end of 2004, The State Power Grid Corporation Group formally proposed the development of "Ultra-High Voltage" transmission technology at meeting, constructing "UHV" grid at the core of the new strategic concept of the national power grid-406 billion yuan will be used to combining power grid which dispersed in the northeast, north, northwest, central China, east China together with 15 years ,in order to achieve power resources in the optimization. Construction of this was brought about a large number of opposition with power experts from the beginning, but in a dissenting voice, the "UHV" construction did not slow down, this incident can not promoting people to thought.The paper tries to analyze its decision-making process deeply around "UHV" incident, revealing a number of unscientific and undemocratic aspects of its decision-making process from the legal point; And bring forth the direction of reform of large-scale construction project decision-making legal mechanism on the basis of in-depth analysis , so that decision-making more scientific and democratic. This paper is divided into three parts:Part I: Bring forth questions. Through the presentation of "UHV" incident, revealing many abuses which exposed in decision-making process of China's large-scale construction project, thus extract the subject of this paper, that is, from a legal point of view to perfect it.Part II: From the point of view of economic democracy to analyze the decision-making process of "UHV", pointing out its failure to reflect economic democracy. First of all, "UHV" did not hold a hearing , but the relevant departments of the state approved it. "UHV" as a large-scale construction project, have many significant influence on the economic, social and environmental and the public generally concerned about it, a hearing should be held without a hearing, not conducive to the realization of democracy, did not reflect economic democracy. Secondly, the "Ultra-High Voltage" did not conduct environmental impact assessment. This construction project may be have a significant impact on the ecological environment and the survival of mankind, according to the law ,should be carried out environmental impact assessment, but this link was skipped in the actual decision-making ,neglecting the influence of large-scale construction project on public environmental interests .Part III: Countermeasures and suggestions. Against the question of the decision-making of the "UHV" construction project, proposing countermeasures and suggestions with a view to promoting China's large-scale construction project decision-making process more scientific and democratic from three aspects. First, to establish a scientific and democratic decision-making mechanism of large-scale construction project, this paper discussed from four aspects as follows: To establish a scientific decision-making body of large-scale construction project; To establish and improve expert consultation mechanism of decision-making of large-scale construction project; To establish and consolidate the hearing system of decision-making of large-scale construction project; To establish decision-making procedures of large-scale construction project and fixed it. Secondly, to consolidate and perfect the system of environmental impact assessment of the decision-making of large-scale construction project and establish the public participation in environmental impact assessment system and design a public participation system. Finally, to establish and improve decision-making accountability system of large-scale construction project, to norm and constrain governmental policy-makers from a legal point .Through bearing the adverse consequences of decision-making, to constraining decision-makers.
