On The Construction Of Civil Litigation System

In recent years, the damage of public interest, such as the loss of state-owned assets, the air pollution and the unfair competition become more and more serious. The serious and extensive damage of civil public interest calls on the establishment of civil public interest lawsuit systems in China. Public interest lawsuit originates from the Roman law and has a long history. However, the civil public interest lawsuit has a comparatively short history. Especially so far in our history, China lags far behind others in aspects of legislature and judicature for public interest lawsuit. Based on the connotation, characteristic of civil public interest lawsuit and the relevant systems in the foreign countries, the thesis tries to research the necessity and feasibility of establishing the civil public interest lawsuit systems in China, how to delimit the certificate for persons who claim, the range of case process, the protection of procedure and to provide corresponding advice in order to do good for the establishment and development of China's civil public interest lawsuit systems.
