Administrative monopoly is a tumor in the development of the market economy in China, which seriously hampering the development of China's market economy pace. China's administrative monopoly is an action that the enterprises associate with administrative institutions in some forms and use administrative power to build political barriers which forms an exclusive control in the process of the market economy. In this paper, the problem was discussed based upon the latest content of China's Anti-Monopoly Law. The first Chapter discusses the basic theory of administrative monopoly issues in the current stage, analyzing from the concept, classification, composition, characteristics of administrative monopoly. Then put forward that the main body of China's administrative monopoly is enterprises which supported by the special administrative power. Those experts who hold this view are rare in china's theoretical circles. The second chapter expounds the nature of China's administrative monopoly, and detailedly analyse the regulatory system for the value of administrative monopoly, which for the purpose of providing a theoretical basis to regulate the system of administrative monopoly. Chapter3 discusses the current anti-monopoly legislation administrative situation and its defects in China. This chapter summarizes the content of regulation of administrative monopoly in China's Anti-Monopoly Law in detail. The last chapter is the most important one in this paper. The chapter offers some recommendations to resolve the China's administrative monopoly problems, especially for the suggestions to perfect the construction of China's Anti-Monopoly Committee, which is brought forward for the first time in this paper.
