Two Legal Guarantee System Concept Corresponds To The Study

The academic circles have the different viewpoints about whether concepts of guarantee system in two legal systems correspond to each other. After my comparison and analysis of concepts the following results are provided: guarantee system in two legal systems correspond on the whole, but there are some differences in the concrete contents; On the other hand because of the difference of law origins and the legal culture between the two legal systems, there are non-correspondence in some concrete legal concept between the common law system and the continental legal system. Guarantee system is divided into persona guaranty and material guarantee, which have been discussed respectively, in the thesis. The thesis is divided into three parts; the first part is about comparative analysis of persona guaranty, which is the first chapter of this thesis; The second part is about comparative analysis of material guarantee,attempting to find the similarities and differences between two legal systems, which is the second chapter of this thesis; The third part is a summary of the thesis on foundation of the first two parts, which is the conclusion part of the thesis.
