Foreign investors' security investment in China is a phenomenon coming together with the open-up of Chinese security market, which emerged in 1990s when the B Share market established, and have attached more attention recent years as a result of the importation of QFII and strategic investment systems.A research focusing on the regulatory level of this type of foreign investment, purposes to find out and summarize the current situation of China's laws and rules on foreign security investment, explore the measures and key areas for supervision and administration of foreign security investors, dig out the legal protection and remedies available to foreign investors, look into existing problems and find practical countermeasures, to shape a sound legal environment of security investment for foreigners, and to serve for a further internationalized security market in China.The thread of this paper is that: Firstly, starting analysis from the nature of foreign security investment, discussing the legal status of foreign investors' security investment in China and setting out the legal relationship and legal rules of foreign security investment in China. Then, discussing the basic rules, legal relationship, practice development and existing problems respectively for three modes of foreign security investment, namely, B share, QFII and strategic investment, making comments and setting forth several suggestions for improvement. After that, focusing on the two key issues - supervision and protection - to discuss in separate chapters, line out the current legal rules and give suggestions on further perfection of supervision and administration mechanism, reduction of financial risk, strengthening investor protection and solving investment disputes appropriately.The stands of this paper are that: It is a trend of history to open up the security market in China, and the approach should be step by step. This open-up shall happen together with the development and perfection of the security market itself and the reform of the foreign exchange administration, and shall be backed up with a more and more effective legal regime of foreign security investment. The channels of foreign security investment may be increased in the future practice, and to the extent that the market has already opened, we should provide the foreign investors with a fair and reasonable legal status, clear and logical rules guidance, proper protection on their interests and prudent supervision and administration. A positive interaction between legal environment and economic development will make the China's security market more attractive to foreign investors, and then, they would play a more contributive role in the way of China's development...
