Our Discussion On The Registration Of Divorce Into The Litigation Divorced

Marriage is a important event in life.The family is a cell of society,while marriage and family is the miniature of the society.Marriage and family issue is not a purely "private issue",but a major event with social significance,and it has a beating on the nation's prosperity,social progress and human civilization.It has attracted much concern and lively discussion that Marriage Law revised every time.How to improve the divorce system is a hot issue of amendments to the Marriage Law.There are two traditional forms of divorce,registration divorce and litigation divorce,and they have been playing important roles.After the "Marriage Registration Ordinance" enacted,the process of registration divorce is becoming more and more simply.The registration divorce becomes the first choice of the parties.However,the registration divorce gradually exposes its shortcomings in practice,and it brings some negative impacts.In order to make the parties of the divorce case interact in harmony in the future, and protect the legitimate rights and interests of children,the author believes that China's divorce system should be improved.The author studies the characteristics and historical developing proceed of registration divorce and litigation divorce,and compare China's litigation divorce with Hong Kong's.The author suggests to integrate China's registration divorce into litigation divorce.Further more,it is suggested that specific process of litigation divorce should be established.There are three parts in the article.Part one:The outline of litigation divorce.The author suggests to integrate registration divorce into litigation divorce,and establish specialized Family Court and litigation proceedings.Part two:The author discusses the necessariness of integrating registration divorce into litigation divorce.Part three:The author discribes the proposal of the operation mode for integration registration divorce into litigation divorce.
