Study Of Foreign Product Liability Laws

This essay is main to discuss and compare legal responsibility of foreign product at home and abroad. The first part is to introduce the general situation about the responsibility of foreign product. First of all, I draw some definitions in responsibility of foreign product from Europe and America, making clear what is responsibility of foreign product, and foreign product's extent and the definition and modality of defect, and more the body of responsibility of foreign product. As follow, I will present the special character of responsibility of foreign product. At last, the responsibility of product's component will be discussed. Responsibility of product and criterion of liability will be approached at the second part, in the one hand, the main criterion of liability which is about product's responsibility will be introduced, discussing with some certain regulations and theories. On the other hand, arguable subjects of foreign product in Europe and America and in our country will be presented. The third part refers to the dominion of responsibility of foreign product, and how the American have jurisdiction over the cases of responsibility of product, discussing some dominion regulations of responsibility of foreign product in our country, presenting some regulation in Declining Jurisdiction in Private International Law . Lastly, some suitable legal principles which are about the responsibility of foreign product will be approached, concerning the recent development about some proper law that is focus on international responsibility of product, and then link to the proper law of responsibility of foreign product in our country. The last part is aiming at some problems in the legal law about responsibility of foreign product, proceeding to perfect our country's legislative of product responsibility and proper law. And I will present some private opinions, hoping that the law of responsibility of foreign product in our country will become more and more perfect.
