On The Couple's Daily Chores Agent

The agent right of daily household affairs is a kind of special entrusted right, which is an important legal system used to standardize the conjugal relation in the traditional relative law. The legal system meaning changes gradually with the changes of times, but it has such a great value to regulate the couple's relation , maintain the safty of transaction and protect the interest of the third party , so that it is legislated to confirm by many countries.Although the article 17 of "the tnterpretation on the application of Marriage Law ( I ) " stipulated by Supreme Court adopt the applicable principle of agent right of daily household affairs, marking the siganificance breakingthrough in Chinese marriage law , it is slill not adopted by our current marriage law in china.This thesis mainly analyse and explore the legal system with a view from judicial practice. Based on all kinds of advanced theories in other countries, the author point out the defect on current marriage law not to adopt the system. The intent of the thesis is to grope for the suitable agency system of daily household affairs in China. There are four chapters in this thesis. The first to third chapter will explore the historical evolution, definition , and legal funcation of the system, analyse the legislative satuiation and judicial practice on the system, speculating out that establishing the system in our country is really critical and necessary . The fourth chapter will bring forward suggestions on improving Chinese marriage law, propose introducing the related advanced institutions of foreign countries in order to perfect Chinese marriage law.
