Owned Construction Land Use Right Transfer Auctioneer

This article intends to conduct a study on the issue of the auctioneer of the assignment of the right to the use of the state-owned land in the urban areas (hereafter referred to as "the land"). In the preamble, the author analyses the context of legislation to protect state-owned assets and the author's writing power and propose topic in this paper. And then the author summarizes the research results including state-owned land use right transfer process, the government acts anomie, the state-owned land use rights transfer system, as well as the problems in the land auction process from an economic point of view.In Chapter I, the author analyses the development of the auctioneer of the land with the changes of State-owned land use right, mainly in three phases, no auctioneer, single kind of auctioneer and several kinds of auctioneer co-existing; in section II, based on auction data the writer analyses the current situation of auctioneer and try to find out the reasons for this status quo, which are system inertia, factor in auction company itself and benefit factor.In Chapter II, the writer believes the assignment of the land is one of civil acts, which is the theoretical foundation of the choice of auctioneer. In Section II, from the government's functions, legal equality, value-added state-owned assets to three perspectives the writer weighs the pros and cons of the two kinds of auctioneers. Finally, it comes to the conclusion that auction company is better for being auctioneer of the land.In chapter III, the main chapter is an attempt to provide a simple conclusion of system design and the corresponding recommendations to improve the law. These mainly include restriction of the government's commissioned rights, perfect supervision, the application of substantial contracts and good remedy system. In section II, the writer mainly proposes some improvements regarding these shortcomings in current legal system.
