Folklore And Its Protection Of The Law

Folklore, originating from different groups, is not only the traditional cultural treasures of one nation or the whole mankind, but also the sources and the foundation of maintaining cultural diversity and creating the modern folklore. Nowadays, having realized the huge potential value, more and more countries come into a common sense to take legal actions in order to avoid the folklore abuse and safeguard the economy and cultural benefits of the owner of rights. The dissertation , emphasis on the influence of folklore objects to the research of folklore illegal protection , is consisted of 4 chapters. The first chapter discusses the definition and contents of folklore on the bases of Chinese present situation compared with some similar concepts and other countries' relative regulations ; the second chapter deals with the essential attributes and express characteristics supported with amounts of examples; the third chapter proposes to design the rights of folklore , further works out the frameworks of rights of folklore which encourages the reasonable use without excessive restrictions; the last chapter, through studying the practical protection system of folklore carried out in different districts , comes to the conclusion that there should be a comprehensive protective model of folklore in our country including the special law on the aspect of private law and other public law's regulations.
