The U.s. Rules Of Origin And Its Significance In China,

From the date of origination, the Rules of Origin is a kind of skill rules. It's a tool to identify the identity of goods, to count the quantity by the custom agency, not the barrier to the trade. Because it sometimes serves to some special economic policies such as limitation to the importation, it becomes a kind of barriers to the trade. As the custom tariff has been cut down sharply in recent years, its effect on trade protection is much smaller. But at the same time, non-tariff barrier takes bigger effect on the international trade. To do some research on Rules of Origin which is the substantial non-tariff barrier is very important. Meanwhile the United States as one of the most important trade partners of our country has the longest history of the rules of origin. It's not only good at making and using the rules of origin, but also has huge impact on the practice of other countries as well as the WTO.There are four parts in this paper. The first part includes the fully research on the US rules of origin, it covers not only non-preferential and preferential rules of origin, but also the rules of origin of the NAFTA. The second part includes about the rules of origin of our country; the disadvantages of it compared to the US's are the essence of this part as well as the full paper. The third part includes some advices to the rules of origin of our country, which also includes the conclusion of this paper. The last part includes the case analysis of the "measures on effecting the importation of automobile parts" from the point of the rules of origin, which is the first case that our country being the defendant in the WTO. It's one chance that the author can connect the theory to the practice. There are some theorical analyses bsed on the former researches through the whole paper. It can be seen as another characteristic of this paper.Meanwhile, the Agreement of the Rules of Origin of the WTO is a compromised result. Each country can make its own rules under the principle of the WTO. So this part of the Rules of Origin will not be involed in this paper.
