| Expropriation has always been a hot issue in international investment legal system.From confiscation,nationalization to expropriation,the terminology has changed with the development of world economy.At the same time,the hot issue has also changed.As a result,the study of traditional theory of expropriation is as important as the study of its development.This dissertation is consist of there parts.Part one is the discussion of the legality of expropriation.It further discussed the legality from the perspective of sovereignty;the conditions of expropriation in customary international law;and the relationship between investment treaties and expropriation.Part two discussed the types of expropriation:direct expropriation and indirect expropriation.It is not only a distinction of measures they each takes,but represented the development the concept of expropriation.There are the discussions of basis problems of direct expropriation in this part. And it emphasized on the study of indirect expropriation.Part three discussion the methods of protection from expropriation from the perspective of OPIC. |
