The current status of execution in Chinese court can hardly satisfy people in China. It has been a common knowledge that execution in China is very hard and disordered. Also, misfeasance appears when execution is proceeding and could not be held back effectively. Several reason caused this situation, among which the lacking of exterior intendance to execution is the most important. As a law intendance organ powered by the Constitution, it' s the duty and obligation for the Procuratorate to supervise the execution of court. But currently, no such law which stated that the superintendence of Procuratorate and how the superintendence should be proceeded. So people have different opinions both on whether the Procuratorate should supervise the execution and how to supervise, both theoretically and practically.
