On China's Reeducation Through Labor System Is Perfect

The system of labor education and rehabilitation is a unique legal system in China since established. It has been existed over fifty years, its characteristics have changed with the change of the adoption objectives, but the mission of "reeducation, reform and saving" remains the same. The system of labor education and rehabilitation has played very important effects in keeping social order, prevent and reduce crimes and ensuring socialism modernization. However, along with the course of nomocracy in China, the problems and shortcomings of the system have been more and more obvious, its validity was double doubt. The system has become a hot issue between "keep" or "depose". In the past few years, many directions about the reform of the system are brought forward, some good some bad, in my opinion, as a unique legal system in China, although facing deficiency and limitations in today' s "rule of law" society, the System still has its own value and significance.This paper is divided into 4 parts. Foreword leads to the question, introduces some research background. PartⅠmostly summarize of the system of labor education and rehabilitation. introducing the concept,law quality and effect etc. PartⅡcomparative research of relevant overseas laws, indicates their commonness and difference, and discuss feasibility to improve the System. PartⅢmainly describes the status quo of the system, this part also analyzes the problems of the system and labors their reasons. PartⅣdemonstrates the necessity of improving the system of labor education and rehabilitation, some thoughts of legislative reform of the system in dimensions, integrated with evaluation of current reform and my personal opinion on nature of the system.No matter how the System will finally evolve and consummate, it is hoped that this paper can be of positive influence for the System to better serve China' s grand cause of reform, opening-up, modernization and social harmony.
