During the business deal with real estate developers,the contractors of construction projects and the customer of pre-sale condominium are both disadvantaged groups who are specially protected by the law.The priority of construction projects is given to the contractors,while the forenotice registration is provided to the buyers by the law.How to balance those two principal parts'interests and avoid the conflicts of those two systems' function is the emphasis of this article.Firstly,the origin and development,the characteristics,the legislation value and the difficulties in execution of the priority of construction projects were introduced.The statutory and priority were specially expatiated,and"Law gives special protection to the disadvantaged", which is the legislation value of this priority,was revealed through the analysis of those characteristics,then the difficulties in this rule's execution induced by the lack of publicity were researched.Secondly,the origin and characteristics,the legislation process in China and the quality and effectiveness of the forenotice registration were presented.The legislation progress of this rule were emphasized,and the three main legal effects which provide extremely important protection for customers during the business deal of the pre-sale condominium were focused here.Lastly,the lawmaking necessity of the forenotice registration of the priority of construction project was presented,considering the actuality that the priority of construction project is disadvantageous not only to the effective protect of the Contractors,but also to the third-party's transaction security.And the feasibility of this rule were evaluated,in view of the value orientation,the system function,and the legislation process of this rule in other countries.Besides,the key problems which should be concerned during the establishment of this rule were especially analyzed. |
