The paper studies picking up lost property and the validity of picking up lost property. It also discusses the rights and the duties of the pickers. The paper consists of three chapters.Chapter one introduces the purpose of making the law, then gives the definition and the elements of lost property. The definition of picking up lost property is given too. In this chapter, the disputes about whether or not to distinguish lost property and forgotten property are mentioned. The reasons why this paper favours confirmation and the methods to distinguish lost property and fegotten property are also discussed in this chapter..Chaper two discusses the validity of picking up lost property—the rights of the pickers. Firstly, the rights of the pickers in Positivist Jurisprudence are introduced. Secondly, the rights of the pickers are elaborated theoretically—asking for reward. As to this duty, the different modes like German, Taiwanese, Swedish, Russian are discussed in detail. This chapter also gives some cases of the ownership of lost property and getting lost property out of goodwill.Chapter three elaborates the validity of picking up lost property—the duties of the pickers, which includes informing, reporting, keeping, and returning back.
