Privacy is the confidential information that once revealed, there is much hurt to the person's self pride. The revealed details results in his sense of shame and brings much influence to his regular life. Later, this person will be diminished by others. The right of privacy is the right to protect one's own private information. However, in china, there is no special legislation on the right of privacy; instead, there are only some legal documents. In the real world, the case that violates the right of privacy happens occasionally. The violating subject includes the Organs of the state power and social person. The evidence materials that violate the right of privacy are becoming more and more. In view of this, this article studies on the evidential effects of the evidence that violates the right of privacy.This article consists of four parts:The first part mainly introduces the definition and development of privacy and the right of privacy. The writer defines the context of right of privacy and provides a brief view of the evidence that violates privacy. It is a theoretical basis to the following parts. In the second part, the writer concludes that in the evidence process, there are two aspects violating right of privacy, that is investigating the evidence process and the context of evidence. The third part concerns on the evidential effects of violating right of privacy from two points of view: substantive justice and procedural justice. Finally, the writer puts forward some effective proposal to judge the evidential effects of violating right of privacy. The fourth part is the conclusion and gives some legislative proposal.
