Trade Unions To Safeguard Migrant Workers' Rights

Migrant workers, as a special group emerging in China's social transition , who have made great contributions to China's economic and social development, however, their rights have not been duly protected. In the long run, it would not only exert bad effects on migrant workers' enthusiasm and creativity into propelling China's industrialization, urbanization and modernization, but would also threaten China's social harmony and stability .It is urgent to safeguard the legitimate rights and interests of migrant workers, which is a concrete manifestation of the people-oriented. This article will base on the proposition that migrant workers belong to the "new class of industrial workers" in China, proving that it is trade unions' duty to safeguard the migrant workers' legal rights and exploring ways to safeguard the rights and interests of migrant workers. This paper will divided into five parts to prove the point, as follows:Introduction,Chapter2,Chapter3,Chapter4,Chapter5,In addition to the presentation of topics with the source of meaning, Introduction also summarizes the related materials, putting forward ideas and methods. The sencond chapter mainly deals with the rights and interests of migrant workers and their missing ones legally. It takes ChengZhou city for example, describing its migrant workers' condition on missing legal rights and analyzing reasons from system,social thoughts as well as migrant workers themselves. The third chapter introduces the qualification and main duties for trade unions to safeguard the rights and interests of migrant workers. It starts discussing that the migrant workers have become a new member of the working class from three aspects: the theoretical basis, reality, the development trend. Then it demonstrates that it is the trade unions' responsibility to safeguard the legitimate rights and interests of migrant workers from the trade unions' emergence, nature and their legal status . Finally, it uses game theory and theory of public goods on the rights to analyze trade unions on protecting migrant worker's legal rights, putting forward that trade unions can reduce costs and improve efficiency by doing that. Chapter 4 mainly analyses the current situation on trade unions' safeguarding the rights and interests of migrant workers. It firstly introduces the main ways of trade unions in safeguarding the rights and interests of migrant workers as well as their effects. Then analyses main reasons resulting to confusion in trade unions' safeguarding the rights and interests of migrant workers, pointing out the major hazard and phenomena of trade unions' improper safeguarding act. The fifth chapter introduces trade unions' ways in safeguarding rights of migrant workers, exploring new ways and new channels based on four aspects, that is, how to improve the Organization of migrant workers. How to enhance their awareness of self-protection as well as develop harmonious labor relations with cooperation. How to upgrade trade unions' capability on safeguarding migrant works' legal rights, how to enhance the employability of migrant workers.
