| Because of its enormous economic interests and a wide range of social influence, the usage and protection, restriction and interest conflict of patents of the pharmaceutical industry has become one of the most controversial areas in the globe trade related intellectual property right issues. The characteristics of substantive conditions for pharmaceutical patents are first analyzed, and then the regional, national and international legislations on patents of the pharmaceutical industry with latest progress and special provisions are introduced combining with the balance and conflict of public and private interests. The author also introduced domestic and foreign cases to the analysis and elaboration in order to sum the current trend and practice in the pharmaceutical industry on patent issues, and provided some advices for national legislation, administration and corporate strategies on drug patent regulation and utilization.Chapter 1 focused on the characteristics in substantive conditions for pharmaceutical patents. Then the special alternative regulations and systems as well as the pros and cons for pharmaceutical patents protection were introduced and analyzed.Chapter 2 introduced the constrictions and interest conflict existed in the pharmaceutical industry.Chapter 3 mainly dealt with the initial development and influences of domestic laws and regulation in pharmaceutical patents system and industry. Then the most update statistics were introduced to strengthen those impacts.Chapter 4 compared and analyzed several different strategies for pharmaceutical industry to utilize the patents and non-patent methods. |
