Entity Specification For Rtas In The Rule Of WTO

WTO has 153 members up to July 23,2008; Some 421 RTAs have been notified to the GATT/WTO up to December 2008. Of these, 324 RTAs were notified under Article XXIV of the GATT 1947 or GATT 1994; 29 under the Enabling Clause; and 68 under Article V of the GATS. At that same date, 230 agreements were in force;From the above ,we can know that most members of WTO can join one one or more RTAs,how WTO to deal with the rapid increase RTAs ? and make the RTAs have a good development in WTO system,they are together to promote world trade healthy and harmonious development.The emergence of RTAs is the exception of Article 1 of GATT,Article 1 is MFN (Most-Favoured-Nation Treatment),so ,how WTO to do ? how to make the RTAs development go well? A lot of rules of WTO with respect to RTAs,some about procedure; some about substation.In view of my limited ability ,I have to solve with some rules about RTAs in WTO ,and the other ,for example ,DSB and CRTA ,But this is my weakness,I can not have the enough time and energy to write about this ,so ,I want complete this part in the future ,I will work hard and make this paper perfect.For paving the way of necessary theory ,this paper begins with the general theory in order to achieve the system as complete as possible ,Based on the introduction of standards-setting of the nationality and practice of development of world trade ,we can introduce the concept of WTO and RTAs,and the origin of the two ,and write about GATT 24and its Understanding , GATS 5 and the Enabling Clause ,after writes ,we found that there are problems concerning certion unclear provisions,so we must make the concerning rules of WTO more perfect ,and make the two development in common .In addition to the introduction and conclusion ,this article is divided into four chapters ,specific arrangements are as follows:Chapter one is the two most important ways in the world trade :WTO and RTAs; Chapter two is the legal history of WTO and RTAs;Chapter three is the legal rules of WTO on RTAs,this chapter is the important of this paper; The last is not the least, the last chapter is reformation of and suggestions on WTO related to RTAs, this chapter is the innovation of this paper ,I want to make some concerning rules of WTO more perfect ,make the RTAs developping follow the rules of WTO,and to harmonize the parallel operation relationship between WTO and RTAs, in order to facilitate the development of the world trade.In this paper ,I want to try the two research methods: The one methods is historical analysis,the brief description of the development process of WTO and RTAs; The other methods is empirical analysis, during the process of my writing this paper, I can use the concerning legal provisions to describe some questions .
