The punishment of the taking bribe crime is always one of the problems which have been thought much of by the party and the state. The punishment of the bribe crime is related to the long-term stability, the rise and fall and the honor of a country. The taking bribe crime often occurs in the real life, and also causes harm. The taking bribes is also the focus of criminal law scholars, many scholars study the taking bribe crime. Over the years there has been a large number of related academic works available at home and abroad, conducting fruitful research to the main body of taking bribes. In spite of this, it is still controversial in the scope of the main body of taking bribes in China's academic circles, Practice in the judicial sector also have different views. Thus in this paper some problems that exist in the main body of taking bribe will be analyzed and discussed.This article is divided into three chapters:The first chapter is the staff of state organs. This chapter is divided into two sections. The first section is the scope of the staff of state organs; the second section is the meaning of engaging in public service.The second chapter is the national staffs who are not come from state organs. This chapter is divided into three sections. First of all, section I is talking about the state-owned companies, enterprises, institutions, people's organizations engaged in official business. Second, section II is about the persons engaged in public service Appointed by public officials. Last, section III is the definition of other officers in accordance with the law to engage in public service.Chapter III is the special circumstances of the main body for taking bribes. Section I is discussing the persons who are entrusted to manage and operate the state-owned property, and constitute the main body of taking bribes; Section II refers to the retired national staff member constituting the main body of taking bribes; Section III is talking about the staff of the Buddhist Association constituting the main body of taking bribes; Section IV is analyzing a particular relationship persons with the national staff who constitute the crime of an accomplice in the issue of bribery; Section V is describing the closely related persons to pose the main body of taking bribes; Section VI is talking about whether the staff of private enterprise affiliated to state-owned companies can constitute the main body of taking bribes.
