As the economic globalization and scientific and technological modernization continuously develops ,we are enjoying the rich fruits of those development ,one of which is the international air transport. The air transport industry has the inherently international and professional nature , which make it vulnerable to all kinds of disharmony factors .Terrorist attacks is one of the most serious treats to the international civil aviation .In the course of development of the civil air aviation area , the use of aircraft as weapon becomes the preferred targets of terrorism , which ,in this way , can cause widespread and far-reaching influence to the international community .The"9-11"terrorist attack on aircraft demonstrated that attacks on aircraft used for civil aviation has become the greatest threat to civil aviation .In particular,"new and emerging threats"against civil aviation such as the use of aircraft as weapon to attack ground or air target are exposing the disadvantages of the existing legal framework protect aviation safety .Based on this ,under the auspices of ICAO ,the international community began the modernization of conventions on international aviation security.This paper starts with the content of the existing conventions on unlawful interference with international civil aviation , and then study the necessity ,process and the preliminary results of the modernization .By comparing with the conventions ,the author points out the shortcomings existing in China's legislation such as"Civil Aviation Law","Criminal Law"and other laws and regulations .In the end ,the author proposes several suggestions for perfecting the relevant domestic legislations .There are totally three parts in this paper , which includes the foreword , the main body and the conclusion .The main body is composed by three chapters.In the first part , the writer study the overview of the background of the modernization of conventions on international aviation security . General introductions are made to the intents and main contents the legislations ,such as The Tokyo Convention 1963, The Hague Convention 1970,The Montreal Convention1971and Protocol for the Suppression of Unlawful Acts of Airports Serving International Civil Aviation 1988.In the second part ,the writer analyses the phase fruits of the modernization of conventions on international civil aviation security .This section first analyze the necessity of modernization of the international conventions on aviation security ,which includes the drawbacks and shortcomings existing with the conventions and need to counter the"new and emerging threats"to civil aviation after"9-11"attack.Then the writer describes ICAO special sub-committee's process of modernization of the convention .In the end ,the writer discusses in detail the stage achievements of the special committee of ICAO, which include the Draft Protocol to The Montreal Convention 1971 and the Draft amendment to The Hague Convention 1970.In the last part , the writer assess China's relevant legislations and practice .In this part ,coupled with the achievement of international community in the modernization of conventions on aviation security , the writer propose several suggestions to amend the relevant legislations in China.
