Private Law Remedies, Rights And Interests Of Female Spouse Of Weakening

Nowadays, women are regarded as a unique landscape. Their rights and interests have aroused common concern. However, in such context of our society, women's rights and interests of spouse are showing a weakening trend to a certain extent. Meanwhile, women's rights and interests of spouse could not get the effective relief due to the imperfect law, the exclusion of women in socio-economic, cultural and other aspects. Thus, the rights and interests between men and women are imbalanced. With the continuous progress of the study on conjugal rights and the awakening of feminist consciousness, women's rights and interests of identity in marriage have been concerned by more and more people. In this paper, the author will search into related legal remedies aiming at the weakening of women's rights and interests of spouse.The article is divided into introduction, body and conclusion, a total of more than 30,000 words. In introduction, the author gives us a brief summarization about the original intention and perspective of this article. In chapter 1, starting with morpheme, the author summarizes the definition and contents of women's rights and interests of spouse. Then, in accordance with weakening phenomenon, the author talks about women's rights and interests of cohabitation, chastity, and reproduction in detail. In chapter 2, the author shows some weakening phenomena of women's rights and interests of spouse by way of empirical investigation, so that we could clearly realize such a serious fact that women's rights are being ignored. Then, the author discusses the exclusion suffered by women in socio-economic and cultural fields by using the theoretical analysis of social exclusion. In chapter 3, having examined the relevant legislation in China, The author points out the disadvantages of existing laws in protecting women's rights and interests of spouse. Then, on the basis of foreign advanced legislation, the author gives her advice on how to improve legal relief and social assistance. Finally, in conclusion, the author restates the general content of this article, so that we could be fully aware of many challenges we will encounter when protecting female rights and interests of spouse. I do believe we could build up a clear purpose towards which we should strive in legislation and social assistance.
